PHOTOGRAPHY SESSION AGREEMENT
1. THE SESSION. The Photographer agrees to photograph the session described
above on the agreed date and time. The Client agrees to arrive on time;
sessions that begin late may be shortened to protect later bookings.
2. RETAINER AND PAYMENT. A non-refundable retainer reserves the date. The
remaining balance is due on or before the session date. The date is not
held until the retainer is received.
3. RESCHEDULING. The Client may reschedule once at no charge with at least 48
hours' notice. The retainer transfers to the new date. Later changes may
require a new retainer.
4. WEATHER. Outdoor sessions may be moved by the Photographer for weather. A
weather reschedule never costs the Client anything.
5. CANCELLATION. If the Client cancels, the retainer is forfeited. If the
Photographer must cancel and cannot reschedule, all monies paid are
refunded in full.
6. DELIVERY. Edited images are delivered by online gallery within the number of
weeks stated for the session type. The Photographer selects which images are
edited and delivered; unedited files and RAW files are not provided.
7. COPYRIGHT AND USE. The Photographer retains copyright in all images. The
Client receives a personal-use print release: print, share, and reproduce
the images for personal purposes. Commercial use requires written
permission. The Client may not alter the images or apply filters to them
before sharing.
8. PORTFOLIO USE. Unless the Client opts out in writing, the Photographer may
use images from the session in a portfolio, website, and social media.
9. LIMIT OF LIABILITY. In the unlikely event of equipment failure, illness, or
loss of images before delivery, the Photographer's liability is limited to a
full refund of monies paid for the session.
10. BEHAVIOUR AND SAFETY. The Client is responsible for the supervision and
safety of children and pets during the session.
